I read in another thread (cited below) that someone was exempted from the background check and finger printing for being a corrections officer. My question is this. I am a military police (corrections) officer with active security clearance. I had to pass an extensive background check for this. Am I also exempt and/or will this speed up my application at all? I have not mailed my app yet.

If you are certified from the Criminal Justice Standards and Training Commission as a "correctional officer," then you would be exempt from the background investigation and all background investigation fees.

Also. if you have a DD-214, you also will not have to take the class. All you will need to do is make a copy of your DD-214 and submit it along with your application, photo, fingerprints, and of course your check. :D

790.06 License to carry concealed weapon or firearm.--

(2) The Department of Agriculture and Consumer Services shall issue a license if the applicant:

(h) Demonstrates competence with a firearm by any one of the following:

5. Presents evidence of equivalent experience with a firearm through participation in organized shooting competition or military service;

(5) The applicant shall submit to the Department of Agriculture and Consumer Services:

(a) A completed application as described in subsection (4).

(b) A nonrefundable license fee not to exceed $85, if he or she has not previously been issued a statewide license, or a nonrefundable license fee not to exceed $70 for renewal of a statewide license. Costs for processing the set of fingerprints as required in paragraph (c) shall be borne by the applicant. However, an individual holding an active certification from the Criminal Justice Standards and Training Commission as a "law enforcement officer," "correctional officer," or "correctional probation officer" as defined in s. 943.10(1), (2), (3), (6), (7), (8), or (9) is exempt from the licensing requirements of this section. If any individual holding an active certification from the Criminal Justice Standards and Training Commission as a "law enforcement officer," a "correctional officer," or a "correctional probation officer" as defined in s. 943.10(1), (2), (3), (6), (7), (8), or (9) wishes to receive a concealed weapons or firearms license, such person is exempt from the background investigation and all background investigation fees, but shall pay the current license fees regularly required to be paid by nonexempt applicants. Further, a law enforcement officer, a correctional officer, or a correctional probation officer as defined in s. 943.10(1), (2), or (3) is exempt from the required fees and background investigation for a period of 1 year subsequent to the date of retirement of said officer as a law enforcement officer, a correctional officer, or a correctional probation officer.

943.10 Definitions

1) "Law enforcement officer" means any person who is elected, appointed, or employed full time by any municipality or the state or any political subdivision thereof; who is vested with authority to bear arms and make arrests; and whose primary responsibility is the prevention and detection of crime or the enforcement of the penal, criminal, traffic, or highway laws of the state. This definition includes all certified supervisory and command personnel whose duties include, in whole or in part, the supervision, training, guidance, and management responsibilities of full-time law enforcement officers, part-time law enforcement officers, or auxiliary law enforcement officers but does not include support personnel employed by the employing agency.

(2) "Correctional officer" means any person who is appointed or employed full time by the state or any political subdivision thereof, or by any private entity which has contracted with the state or county, and whose primary responsibility is the supervision, protection, care, custody, and control, or investigation, of inmates within a correctional institution; however, the term "correctional officer" does not include any secretarial, clerical, or professionally trained personnel.

(3) "Correctional probation officer" means a person who is employed full time by the state whose primary responsibility is the supervised custody, surveillance, and control of assigned inmates, probationers, parolees, or community controllees within institutions of the Department of Corrections or within the community. The term includes supervisory personnel whose duties include, in whole or in part, the supervision, training, and guidance of correctional probation officers, but excludes management and administrative personnel above, but not including, the probation and parole regional administrator level.

(4) "Employing agency" means any agency or unit of government or any municipality or the state or any political subdivision thereof, or any agent thereof, which has constitutional or statutory authority to employ or appoint persons as officers. The term also includes any private entity which has contracted with the state or county for the operation and maintenance of a nonjuvenile detention facility.

I also have an active security clearance, this did not speed up the process for me.

Your DD-214 will keep you out of the class, if you consider that helpful.

I used my DD-214 showing my Military Police service and things went through with no problems.

As for your correctional officer status I believe you would have to be certified by the State so I don't think you would qualify that way.

Your DD-214 will relieve you of the necessity to take a CCW class. And the fact that you are active military will make it easier to do a background check on you. But, if you do not hold an active law enforcement or correctional certification with the State of Florida, I believe that you still have to apply as a civilian. I could be wrong on this, however, so you might want to email the DOA. They can give you a definitive answer.

I would take the class anyway !

i didnt have to take the CCW class because of my prior Military service , but I found that taking it gave be a better handle on Florida Law pertaining to handguns and self defense ! Kevin
