Thankfully, we have f.s. 776.013(2)(a) and (b) providing a presumption that the victim possessed a reasonable fear of GBH or death, as well as a presumption that the home invader is doing so with intent to cause said harm [see f.s. 776.013(2)(a) and (b) and 776.013(4)].

Intruder will have to get past German Shepherd and Bullmastiff to attack me and at that point I'll likely not be asleep any more and assume they intend to do horrific things to me (otherwise they would have ran away at GSD).

Open my eyes in the middle of the night and there is someone there that ain’t supposed to be, they will be dancing to the disco flash ball! They would of also had to get by my two dogs & NOBODY gets past my Chihuahua’s ears, let alone my Shepard’s.

Nobody, not even me gets past my kids Bichon Frise's ears, who then barks/growls his fool head off like he's a Rottweiler or something. Not my kind of dog, but he's a great alarm system! :ROFLMAO:

I take people aback all the time, that don’t know me, when I say I’ve got a awesome watch dog & show em a picture of my little guy. They go “ what’s that little thing gonna do to somebody, does he bite? “ I say “ no he doesn’t bite, he won’t even get off the bed, but he won’t shut up till I’m up & that’s all he needs to do!” The whole time he’s raising holy hell, he’s spinning circles on my chest, so Trust me, I ain’t happy when I get up! I can’t remember the last time I’ve slept for more than an hour straight, so pretty darn good chance I’m already up anyways.

Remember reading years ago about the difference between a watch dog, and a guard dog. The watch dog makes a lot of noise, but is not expected to attack. The guard dog may make noise, or may not, but WILL attack.

I have a Chihuahua that mimic's the behavior of BH's Bichon. It never fails, whenever that dog goes off at oh-dark-thirty, my wife awakens and asks me "Why is she barking?" Like I'd know. I have learned to reply, "I think it's someone in the kitchen moving things around on the countertops," because there isn't much in the world that would set her off more than that. The gods of kitchen organization will surely rain fire and brimstone upon anyone silly enough to screw around with her appliance placement, that and she's a fair hand with her 20-gauge when provoked. :D

You are correct, f.s. 776.013 says nothing about the intruder having a weapon or the defender's use of deadly force being dependent upon the intruder having a weapon. :unsure:

I think that was joecarry's point! Although think perhaps the justice system tries to document "motive" as an element of the crime in general when they charge suspects, (i.e., "means, motive, opportunity, etc.")? :unsure:

I've brought up this point SO many times in discussions about violent crime... only to get blank stares or arguments that consistently (and delusionally) posit, "If we can figure out WHY they do it, we can prevent it."

NO! First, the WHY is SIMPLE. They are EVIL. Evil exists. Period. End of story. Next question. And the next question SHOULD be: What can we DO about evil acts?

There is NOTHING we can do to PREVENT evil thoughts and evil actions. Evil will ALWAYS exist. No legislation, policies, or rules will ever overcome evil INTENT. Where there's a WILL there's a WAY. You can't legislate away evil intent.

But, we CAN mitigate the damage caused by evil with awareness and appropriate and AGGRESSIVE defensive action / reaction.

Know your target and beyond. No more complicated than that. Light them up with the flashlight, check their hands, waist and demeanor, and respond accordingly. You might want to hold your fire if they are in a cop suit, wearing a badge.
