I've looked through the posts and can't find a direct answer to my question. Any information would be greatly appreciated. I am getting ready to move my business to a new property with a lease agreement. Since I'm not the property owner do I have to get his permission/authorization to be able to carry in my new store?

I believe the wording included in the statute is "place of business".. but I'm too lazy to look it up!

I'm afraid I'm not sure of how the exact law is worded on that one...but, I think that would fall under more of a "between you and your landlord" kind of thing..

Based on my understanding, you are allowed to carry a weapon at your place of business for the most part. As the landlord is the actual property owner, I suppose they do have the right to tell you no guns allowed on what amounts to their personal property, but, I don't believe there's any specific requirement for you to get the property owner's permission within the law. More of a civil thing if you ask me.

Honestly, this is one of those things where I'd say if it's not specifically addressed within your lease or the guidelines/rules/bylaws governing the property...I wouldn't worry about it. And I certainly wouldn't bring it up. :thumsup

I also feel if it wasn't addressed in the lease aggreament then you should be fine. That is the same as me telling my tenants that I dont want them having a firearm to protect themselves at there house that they rent from me. If it was something in a contract then i can see them saying no as you would have agreed to the terms. Look at all the pawn shops and other stores that have people carrying weapons. there is no way they all own the premisis most probably have leases.

Thanks for the replies. I was thinking that the don't ask, don't tell policy would be best. I don't think the owner would have a problem, but I would like to cover my butt. I've always been the type of person that likes to dot their I's and cross their T's. Maybe I'll ask a few questions and see how he answers them first before i come right out and ask.

I lease a place and I run someone off and tell them to never come back. Now that ahole comes back. He then tells me that the owner has said he can come back anytime he wants to. I lease this place for my business I run this place right. Now its my business and I can defend myself no matter what the owner says in my opinion.

Read the lease first. There will not be anything in the lease probably. But it would have to be there. Sometimes a landowner will insert restrictions in the lease in an attempt to limit the activities or the types of business that may be done on that property.

you are allowed to carry a gun at work (inside) as long as your employer does not mind. In this case you are your own employer you are simply leasing the property. As long as you are a tenant, then you can carry in the business regardless of what the property owner says. Just like if you rent an apartment you dont have to ask for the landlords permission to carry in your own home. You lease the property so your fine. If you dont have a ccw then you cant legally get the gun from your car to your business unless you cross over the landlords property, so in that case I think you would be breaking the law. If you do have a ccw then getting from the car to your business would not be illegal as you can carry anywhere (except as indicated in 790.06 (12))

can you concealed carry at work (while waiting on license to arrive) or is it open carry only? i'm the business/property owner.

Either way you want. Open or concealed it does not matter.

790.25 Lawful ownership, possession, and use of firearms and other weapons.--

(3) LAWFUL USES.--The provisions of ss. 790.053 and 790.06 do not apply in the following instances, and, despite such sections, it is lawful for the following persons to own, possess, and lawfully use firearms and other weapons, ammunition, and supplies for lawful purposes:

(n) A person possessing arms at his or her home or place of business;

I don't know what the laws says about this but I have a tenant who owns a jewelry store. He has five guns in there. I guess it would/should not be a problem until he fires on someone?
