Okay, so I was having a conversation with the maintenance worker where I live. He was interested in getting a CCWL and we were talking about where you can carry and WORK came up. I had told him that you can open carry at your place of employment. The question I have is,

Since he is employed by the apartment complex as a maintenance worker, can he open carry while anywhere on the apartment complex since that is his place of employment.

I'm going to go out on a limb here and say no; at least not without his employer's permission.

What if his employer is okay with it??

would you want to live in an apartment complex where the maintenance staff has guns on?

(but that is hard to explain without sounding against 2A....).

His place of employment would technically be the whole complex. For outside maintenance, it might be a selling point..(armed personnel on site). But once he goes in - it gets fuzzy. I'm renting that apartment and have rights and don't expect to see armed men entering with a pass key. Actually, I don't expect to see anybody entering without announcing themselves.

The more I read your post, the more I dont want him to carry. Actually he is a pretty cool guy and it would not bother me but somethimes he has to show empty apartments to prospective tenants and it would be kind of odd for a family to show up and see the maintenance person carrying a gun. Even pro 2a, I would question if I truly wanted to live there.


Still curious if it would be lagal though.

tactically speaking I would like to see, or not see the gun, and have them go concealled, rather than open carry.

I know all of our maintenance men, and two are currently in the Armed Forces in the nearby Reserve unit. I have absolutly no problem with them being armed (providing they had the proper training), and of course with the property owners consent. I would rather them go concealed though easier on the new or perspective new tennants, and would keep those that would be criminals from knowing which treats need eliminating in the commision of a crime.

To make things more confusing -

There is probably a contract with a management company to manage and maintain the complex. They are not the owners so I'm not sure how that plays out with the law.

Good point. In this case an individual owns our apartments. I have to write a check to him personally rather than the complex or a business name.

My guess is that he's legal to carry, with the owner's permission. As for the issue of management companies, I think Fridaddy answered a similar question indicating that it would still be his place of business if he's employed through a contractor. My apologies to Fridaddy if I got that wrong.

One hour for an opinion letter.

If the property owner allows his maintenance staff to open carry, I think he is going to open himself up to all kinds of unnecessary grief. Legally, he may be within his rights, but if some of the tenants complain, watch out. He can tell them to pound sand, but that isn't going to play well when the local media inevitably gets a hold of this. If Florida was an open carry state, this likely wouldn't be an issue at all, but Florida is not an open carry state and this will become an issue. If a tenant calls the police about a MWAG, they're coming. It may all be settled later in the property owner's favor, but that could take a lot of time and money. Is it really worth it?

Personally, I think open carry is a mistake unless you are in a situation where you are able to continuously monitor your surroundings. And unless your occupation directly relates to firearms, or involves constantly assessing your environment for threats and being prepared to respond to them (such as an LEO), I think carrying a firearm openly while working, particularly in a job involving physical labor, is asking for trouble.
