I have carried CCW for a few years, must admit I haven’t kept up on law changes (not smart of me).try to make this short, I
Got home from doing something when my son asked me to help work on is truck, I took off my shirt with my OWB on not thinking much about it (happens A lot at home)
A guy from down the street stopped by and seen my 1911, he asked aren’t you afraid of the cops. You know I went blank for answer. I live in the county not city, have 2 acres,
Am I looking for trouble or is this ok? Like I thought
Thanks for any help don’t want my boys to see me in bling bracelets Mark – SW Florida

Open carry is OK on your own property, or on private property with the owner's permission. That doesn't mean that you won't get hassled by a LEO or a neighbor who doesn't know the law.

Correction: I'm sure it's OK on your own property. I'm not sure about someone else's with permission.

Mhilsee, tell your neighbor, that according to Florida Statutes you are legal and have no need to fear " Bling Bracelets ". :thumsup

I dont think that the OC the OP was referring to :rolf

If I were to OC, LE would be visiting me in my subdivision sure as the sun will rise. FL does not have an overly open view to OC in general but you can if you want to......just be prepared if the sheep freak out

Problem with Floirda in general is all the tourists from outside FL and even outside US. Alot of these tourists would poop themselves if they witnessed someone carrying OC....especially in and around Orlando. Any given WE that are is significantly populated by foreign tourists.....imagine the calls they would get around there for OC...swithboard isnt big enough

I have heard that said before but can you please provide a statute to back that up? Thanks steve :drinks

I can't. That's why I added the correction that I wasn't sure about "with the owner's permission". 790.053 is the prohibition about open carry, and 790.25 declares it invalid for a person carrying on his own property, but I haven't found the justification for carrying openly on someone else's property with the owner's permission. Like you, I've heard it, but I'm not sure about it.

I'll save you the trouble, Steve....there isn't one. There may be case law to support it, but nothing in the statutes of which I'm aware.

OK. Then why do all of the employees at the gun store open carry?

It is on somone else's property. Is it just the employee status that makes it OK?

My neighbors are probably used to seeing me walk around outside with an M4 slung across my chest, so I don't think they're going to freak out over a pistol. :rolf

I don't think you can be arrested for open carry on another person's private property with their permission, so long as the property owner is present to confirm that he has, in fact, granted permission. It wouldn't make much sense if a buddy and I were standing in my front yard while OCing, then a deputy came along and arrested only him because I was immune. At worst, he'd probably tell my friend to either disarm or cover up. But make an arrest? I find that highly unlikely.

It's not something I'm going to lie awake at night worrying about just because the written statute doesn't expressly allow it. While there are some dunderhead LEOs out there, you simply have to trust that most of 'em actually do have a lick of common sense when it comes to such things. And your demeanor when dealing the LEOs is often the deciding factor about how they treat you in any given situation.

Talk about good timing. I was just pondering this very question on Saturday. The reason I was thinking about it was that I have taken the trash out to the end of the drive and forgot to cover up. Whew, what a relief to find out that it's all good! :dancingbanana Now I will be able to go out to the garage and putter around with the door open instead of keeping the door shut .

Be careful about the walk to the end of the driveway........ at some point you leave private property and enter into the public right of way. At the point you leave private property... well you know.
