Hey All,

App sent in 4/1, on 8/11 I receive this letter stating: "During the course of our review of you application....indicates you were arrested for , or charged with , a crime that may..." . Yeah, yeah, I was young, it was 1995 and I was caught speeding through VA...I got charged with "transportation of fireworks", it's a misdemeanor. So I've called the county court where it took place, they only keep records for 10 years. I did fill out a request for the arrest record which shows that I was only charged with a misdemeanor, I've sent those in. My question is, when they come back and say that they need court records, how do I obtain records that don't exist anymore?

Good question, to which I dont have an answer. I would suggest you call the DOACS and explain the situation to them and have them advise you.

This same exact thing happend to me.

I was arrested for DUI in California in 1993. Misd. charge. CA has since destroyed the records.
I got that same letter 'chraged with, etc, etc.'. What they told me to do was contact CA and get a letter from the County court where it happend (San Diego Co.) that stated the case file had been destroyed. When I got that, I faxed a copy of that letter from CA to the people in Florida, and my permit was in the mail a few days later.

My letter went like this:

RECORD DESTRUCTION VERIFICATION REQUEST
Case : C147496
Name: : censored
D.O.B: 06/19/1973
CA DL: A: censored
SS#: : censored

Hello, I am requesting documentation of the above mentioned case, specifically that it was a misdemeanor charge and that the records have been destroyed. I was able to ascertain through my telephone conversation with the court that this case was indeed a misdemeanor and that the records were destroyed in December, 2006, however I am requesting that verification in writing from the court for another licensing agency in Florida, where I now reside. Thank you very much,

Since the background check saw that a charge existed, the computer in the state will also reflect that, and they'll send you verification that you can fax to Florida.

Ahh, that's just the info I was hoping for. Thanks so much! So I guess if they don't take the arrest records I'll have to go this alternate route.

Thats why we cut off grandpa's hands and put them in the freezer before we buried him. He had no records and you never know when you need a clean set of prints.

Just a quick update, today is 9/18, I've left 5 messages for the "Document Specialists", faxed in my paperwork twice because I thought maybe they didn't get the fax the first time...I'm starting to get a bit worried, the cutoff date is coming up and I can't get a hold of ANYONE over there to confirm what, if any, other docs I need to produce by the rapidly approaching deadline?!

How did they know you were arrested if the documents were destroyed? :confused:
Well, the court told me that they only keep records for 10 years, apparently there must be some sort of record that is kept at the national level, that must contain arrest information? I don't think they'd toss records for a convicted murderer? I'm sure someone here knows?
