I have an issue going on. I recently sold a handgun to a co-workers of mines cousin. I've hung out with the guy here and there and he decided to buy my Taurus PT111 from me. I found out today that last night he got arrested for driving w/o a drivers license and the officer found the gun in his car (with an empty mag). I also come to find out the he doesn't have papers (illegal Alien).. so what do I do, I have my bill of sale and everything and the guy showed me his ID when I asked for it but there's a law that says you can not sell to illegal aliens (which I did not know he was). This has me stressed out.. any Advice??

You can say he misrepresented himself. I would ask him to return the gun and issue a refund. If he failed to do that, then I would declare the gun missing and file a report. Very likely the numbers have been checked anyway in view of the traffic violation. Very likely the numbers can be traced back to you. I do not see any harm in covering yourself.

I just tried to skim through the Gutmacher book to see what I could learn. It's complicated because it was a private sale, which does not require the conditions that a FFL dealer/purchase entails, yet the person is not a legal resident.

I concur with the above posters who advised that you contact a lawyer to get the facts and the law explained to you. This is definitely something that you want to be informed about correctly.

Lesson learned - as precious as our 2am is to us, it just makes sense to always go through a broker and protect yourself.

Since the second amendment is precious to me, I respectfully disagree. I would encourage proof that you made a good faith effort. Copy of driver's license, social security card and signed statement SHOULD suffice. Forcing you to go through a Firearms Dealer is an infringement on your Constitutional Rights, IMHO. If our Sheriffs and ICE people can't figure out who is legal and who is not, certainly requiring you to after making a good faith effort, should not be grounds for penalty.

Copy of driver's license, social security card and signed statement SHOULD suffice. Forcing you to go through a Firearms Dealer is an infringement on your Constitutional Rights, IMHO. If our Sheriffs and ICE people can't figure out who is legal and who is not, certainly requiring you to after making a good faith effort, should not be grounds for penalty.

I see your point, but I've gone through clients for my transfers as well. I can sell myself as you've point out, and you are right, but my ability to maintain those documents is poor and should the sh: censored hit the fan, it's easier for me to point to the broker than take time answering questions in a matter I have no interest being involved in. I'm not being forced, just doing it to shift the burden off myself.

On the thread: Depending on the severity of the situation and your nerves, speaking to a lawyer is probably wise.

If a good faith effort like you said is legal in Florida, and you are good at keeping records, then I agree with you. Who we sell our personal property to should be nobody's business.

Me personally I don't keep records very well, so I'd still go through another so that the proof is in the pudding, so to speak. But I do understand where you are coming from.
Point is, we should encourage folks to do whatever is legal to protect themselves and their rights.

True, i'll just take the bill of sale and copy of his ID to a lawyer and figure this thing out thanks for the your opinions

Of course the broker course is safest. Too bad we need to go to the trouble to be safe doing something perfectly legal. Agree, it is probably not worth the hassle BUT respect for the second amendment is not the motivation, actually it is quite the opposite even though descretion is the better part , etc.

Patrick, I bow to your wisdom (and value of your time). We save it for bigger issues.
