i dont think this has been posted in here for collier county. i saw it on nbc-2.com and called ccso to ask, i was told if i have my LEGAL CCW in a Collier County park what would happen, i was told i would be arrested bucause it is illegal to have a gun in the parks in collier county regardless of state law. i will give yall the main number to check for yourself if you wish... i was fires from collier county government for standing up for my 2A rights and now i hear this... i am pi**ed off bout this..... please be carefull in collier county.

Seems like a pretty dumb law. How will they know you are carrying? I guess if you had to defend yourself while at the park you would shoot the bad guy and then be arrested. Hah! Amazing. Hopefully the preemption law will fix that. Just because its dumb it wont stop them from arresting you and ruining your day. You are likely to prevail in court but the hassle certainly qualifies as "infringing". I wonder what part of "shall not be infringed" some politicians don't understand.. :)

I thought there already WAS a pre-emption law. I find it amazing that we have to pass legislation to force local governments to OBEY EXISTING LEGISLATION. Arrrrgh!

1. Contact NRA and let them Know.

2. When the new bill with the penalties becomes law, send a copy to their county attorney.

It IS NOT illegal to carry in any county park. Doesn't matter what the ignorant person who told you that said. Patrick Buckley, attorney extraordinaire, and member Rich7553, have been fighting this battle for quite some time now. Obviously you don't want to get arrested but if you want to carry in the park it would be advisable to know the preemption statutes and have an attorney on call, just in case some LEO or LEA thinks they are bigger than the law.

SB 402 is suppose to take effect oct. 11/2011 that's a pre-ememption firearms law but not the new one with fine's I was looking for , getting old suck's memory first to go .hopefully someone else will remember

I would carry and get arrested and call Buckley to get me heap big wampum from the town. And while I was doing that I would ask Buckley if your job termination was legal.

Their ordinance is illegal. Violates 790.33. Unfortunately, until October 1st of this year, that statute has no penalties attached. Please find and take a picture of any sign or ordinance and send it to me via PM, or post it in this thread. The guys at Florida Carry are looking for just this sort of thing to pass along to the legal team for action in October.

BTW, the link you posted just has general videos on the page. I couldn't find anything specifically related to your post.

The problem is that several counties knowingly violate state preemption, because right now there is no penalty for doing so. Someone could sue and easily get the ordinance overturned, but would have to finance the lawsuit themselves.

The new version the preemption law, once signed by Gov. Scott, will go into effect 10/1/11, will allow for fines and reimbursement for attorney fees/costs when someone sues the county. And it is clearly established that the county will loose.

State law prohibits counties from passing any (well almost any) ordinances related to firearms or ammunition. But, until the ordinances are repealed or ruled unlawful by a court, any arrest under the ordinance is perfectly lawful.

Yes, Earl. SB402/HB45 are the bills that add teeth (albeit baby ones) to the preemption statute (790.33).

maybe we should have an FCC get together in one of the their county parks, they can arrest 20 or 30 of us and then face 20 or 30 law suits

I love this part of the article:

COLLIER COUNTY, FL - It's currently illegal for anyone to carry a gun in a Collier County park. But it turns out the county's ban violates state law! Some parents we spoke to say if guns are allowed at public parks, their children will have to find a new place to play.
If the ban violates state law how can it be illegal to carry? How does one enforce an illegal law, w/out a major lawsuit?

as i said, i called the sherriffs office to ask and was told i WOULD BE ARRESTED. i told my wife the same thing said in an earlier post, do it and get arrested, she told me get a lawyer first.... any takers?
i think the bocc (board of county commissioners) should get arrested for violating florida state law. as far as my old job, i cant afford a lawyer to fight it so they win by defalt. they claim my work was sub standard but i had above avg evals for 5 years prior, i just didnt kiss new bosses butt in my opinion, but as soon ...... well i am not gonna rant.
anyone hiring... i wont tell you i have a gun.... lol
