Have CWP still 3 day wait

Who is the FDLE?

So I go to purchase a pistol last month from the local gun store. I wander in and select a nice 92 FS.
I drop my nice CWP on the glass case with that smug smile on my face, looking down my nose at those 'regular people' who have to wait....
Then he comes back and says there is a problem... evidently outside the FBI, the instant computer background check and my CWP from the Ag Department, there is another agency, the FDLE that can hold up your purchase without giving any explanation as to why. Therefore you have no way to refute their findings, because you don't know what they are! When I called them up to ask them personally, they simply told me they could not give that information out, even to me.
So, someone just said 'uhm.. yeah, make that guy wait.'



Here is the fun part. If the FDLE holds up your purchase (3 business days) they have to call the gun store back within those three days to clear you. If they don't call the store may sell you the weapon anyway.
The guy at the gun store told me they almost NEVER call back.

He also told me he sold a pistol to a cop, in full uniform, gun and all and the FDLE (Florida Department of Law Enforcement) held up the cop from taking his gun home. He was a police officer!

So in essence, this is telling me the state or FBI background check they do is not enough, there has to be a backup to the background check?
Anyway I got my pistol and everything is fine, I'm just confused by this is all.

I had the exact same problem for awhile. The reason is normally someone with your same name is in trouble somewhere. Your DL # should clear it up but it still comes back with a hit. The way around this is to get a U.P.I.N. ( Unique Personal Identification Number). I beleive you have to go through the ATF to get this. Alot of people dont know what it is. Anywho, they do a check on you and you sign a 'waiver' for your records. It allows them to keep your info on hand. They will send you a # and when you fill out the gun form there is a spot on it if you have one. They will normally ask why you have one, just tell em your problem. It doesn't cost anything but you have to pay your local Sheriff's Office $ 5 to do the finger printing. Even if they already have them on file. You do however loose your anomity because they save your name but it speeds up the process. Alot of other times it will eventually all get cleared up and you can be back on track, but mine was quiet awhile. You'll have to decide if you want to go through all that trouble or wait the 3 days. The FDLE [Florida Department of Law Enforcement] is the agency charged with performing the automated background check on firearms buyers in the State of Florida. That is because ALL automated records checks sent to the FBI from Florida go through the FDLE.

The purpose of the denial for three days, in this case, is to clear up a discrepancy in the automated check return [something like the same name and date of birth as a convicted felon]. If the FDLE can clear it up within three days, they will contact the gun shop. If not, you get the firearm at the end of that time. As far as I know, they only call if they have verified that you are not eligible for the purchase.
How do you know it was "outside the FBI"? Having cleared DOAs check just means any FBI negative was cleared up BUT NOT REMOVED UNLESS YOU SPECIFICALLY APPLY TO THE FBI FOR VOLUNTARY WAIVER. Unless you do, every time you purchase a firearm you will trigger the three day default wait and will clear , eventually with FDLE.

IF you call FDLE withthe Conditional Denial number, they will tell you what the issue is I believe. Then you can address it with the FBI or have the jurisdiction that reported it update the FBI records.
That's very common. When I was a dealer, I got as many 'make 'em waits' as I did approvals....and I only dealt with Military folks! I don't remember getting any 'denials' in the 6 years I held an FFL.
I guess this is still better than the federal government being the clearing agency. Can you imagine if they got in the middle of this.
