I am a student at FGCU in fort myers I will be getting my ccw any time now I have been trying to find info on leaving a gun in my truck while going to class I have seen the thread that says you can drive through a campus with a gun but if I am a student and going to class would it still be legal to leave a loaded fire arm in my truck.

Normally, you would be OK as long as it was securely encased. Unfortunately, the legislature opened the door to restriction a bit by allowing schools to restrict this when it comes to student parking. To make it worse, it isn't clear that colleges can or can not take advantage of this opening, since they aren't part of a school district. Bottom line- I would check with the school administration.

I think you are out of luck.

Here are the appropriate statutes which indicate ANY college or University " facility ". I have a feeling that covers campus grounds and parking lots as well.

My best advice is to speak to an attorney and get his legal advice. If that is not an option, you can go to the Campus Police Office and get their interpretation of the law.

If they say no, have them show you the EXACT Statute, and explain why it forbids you to carry.

WEAPONS AND FIREARMS

790.06 License to carry concealed weapon or firearm.--

12) No license issued pursuant to this section shall authorize any person to carry a concealed weapon or firearm into

any place of nuisance as defined in s. 823.05;

any police, sheriff, or highway patrol station; any detention facility, prison, or jail; any courthouse;

any courtroom, except that nothing in this section would preclude a judge from carrying a concealed weapon or determining who will carry a concealed weapon in his or her courtroom;

any polling place;

any meeting of the governing body of a county, public school district, municipality, or special district;

any meeting of the Legislature or a committee thereof;

any school, college, or professional athletic event not related to firearms;

any school administration building;

any portion of an establishment licensed to dispense alcoholic beverages for consumption on the premises, which portion of the establishment is primarily devoted to such purpose;

any elementary or secondary school facility;

any career center;

any college or university facility unless the licensee is a registered student, employee, or faculty member of such college or university and the weapon is a stun gun or nonlethal electric weapon or device designed solely for defensive purposes and the weapon does not fire a dart or projectile;

inside the passenger terminal and sterile area of any airport, provided that no person shall be prohibited from carrying any legal firearm into the terminal, which firearm is encased for shipment for purposes of checking such firearm as baggage to be lawfully transported on any aircraft;

or any place where the carrying of firearms is prohibited by federal law. Any person who willfully violates any provision of this subsection commits a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.

Tampa, that statute says you cant carry into. It does not state that you can not keep in your car. IMHO Steve was correct in stating it can be in car but school district can have policy overriding it but no indication if college would fall under that exemption

Judge for yourself. FS 790.115:

(2)(a) A person shall not possess any firearm, electric weapon or device, destructive device, or other weapon as defined in s. 790.001(13), including a razor blade or box cutter, except as authorized in support of school-sanctioned activities, at a school-sponsored event or on the property of any school, school bus, or school bus stop; however, a person may carry a firearm:

1. In a case to a firearms program, class or function which has been approved in advance by the principal or chief administrative officer of the school as a program or class to which firearms could be carried;

2. In a case to a career center having a firearms training range; or

3. In a vehicle pursuant to s. 790.25(5); except that school districts may adopt written and published policies that waive the exception in this subparagraph for purposes of student and campus parking privileges.

For the purposes of this section, "school" means any preschool, elementary school, middle school, junior high school, secondary school, career center, or postsecondary school, whether public or nonpublic.

Firearms, Weapons or Explosives

Florida State Statutes 790.06(12) and 790.115 prohibits the carrying of firearms on a university campus. Firearms are not permitted on the FGCU campus, except for those carried by uniformed law enforcement officers or members of the military engaged in authorized training.

The unauthorized use or possession of fireworks, dangerous chemicals, explosive material, dangerous devices capable of hurling a projectile, or other lethal weapons on the FGCU campus is prohibited by Chapter 790.115(2), F.S.S.

'Facilities' do not include parking lots by law. Universities and Colleges are not 'schools' nor are they governed by any 'school district' by law.

You're educational institution has a 'policy' against firearms on the institutional grounds as quoted by TS above, making you eligible for expulsion if found to have one, but that does not make it illegal. FL law does not prohibit weapons on campus...just in the facilities (i.e., the buildings).

Make your own decision.

Dang, just put the freaking gun in your glove box and lock it, and leave it in there.
Do not tell anyone it is there.
If a shooter starts shooting up the school, go to your car and get the gun to protect yourself.
If the college says anything to you about saving your own life, call a lawyer and sue the h*ll out of them for not providing security and insuring your safety.
This ain't rocket science.

They don't have the legal right to search your search, so whether you can or cannot, no one but a police officer and search your car, and even then he has to have probable cause. Don't do anything stupid to give a police officer reason to search your car, and lock it in the glove compartment or better yet a car gun safe.

Another option is don't park on campus, and ride a bike in if you can. I know that probably not what you want to do but is an option.

Related: Went to UCS graduation ceremony this weekend.
I decided NOT to carry because the ceremony was in the Arena (clearly to me, a facility) and left the carry in my car locked in the glove box, parked in the parking garage. Looked up UCS rules and found a prohibition of carrying or possession of firearms for STUDENTS anywhere. Have not found prohibitions against the general public (not students).

Also noted last month, UCF students participated in carrying empty holsters to protest the rule. GO KNIGHTS!!

Can you please tell us what reaction the students received from other students, faculty, staff, campus newspaper or radio, etc?

Was any group particulary supportive, or particulary hostile, towards students who carried empty holsters on campus?

ORLANDO, Fla. -- Students at the University of Central Florida are trying to send a message this week by carrying empty gun holsters and toy guns to class.
Members of the Knight's Rifle Association are handing out plastic water pistols to symbolize carrying real handguns on campus. Each toy has a pro-gun message on each side.
Demonstrators are also wearing empty holsters to protest the law banning guns on the campus.
"If anyone's going to do anything wrong its going to be with a gun that's not registered," student Amy Chaleff said. "
The group's demonstration caused arguments from students who support the gun ban.
"I'm saying, what if one day you have a bad day, and all of a sudden you have a gun?" senior Travis Johnson said
Students like Johnson said arming students will only increase the likelihood of campus shootings.
"I don't think having more guns on campus would make us safer. We have police officers here," Johnsons said.
Demonstration participants said that although campus police have visible handguns, that was not enough to prevent the Virginia Tech tragedy and armed students would have been able to protect themselves when police could not.
"By making places gun free zones you're basically putting targets on everyone's foreheads," student Peter Closi said. "Bad people know they can go to gun free zones and nobody can put up a fight."
After the Virginia Tech tragedy, Florida Gov. Charlie Crist created a task force to look into safety on Florida's college campuses.
The task force met with school leaders, students and police to design a safety plan. The group recommended school-wide communication plans and an update to emergency plans. Schools were also told to make sure campus security agents are well trained.
In response to the recommendations, Crist asked national leaders for more funding, but since then budget cuts have put the extra funding on the back burner.

Students Wear Gun Holsters On UCF Campus To Protest Law

ORANGE COUNTY, Fla. -- Some University of Central Florida students were carrying gun holsters around on campus Monday. They're protesting a state law that prohibits students and staff from carrying guns on campus.

Students with the Knights Rifle Association told Eyewitness News they want to be able to protect themselves in case a Virginia Tech-like massacre happens at UCF.
The UCF students are participating in a nationwide protest all week. They're carrying empty holsters to show that they could be a target if someone walked on campus and started shooting. They said it shouldn't be illegal to carry guns on campus, as long as you have a permit.
The students say police can only do so much and they say shootings at Virginia Tech and Northern Illinois proved that.
""Say a psychopath comes on with a gun and he's just looking to kill people then kill himself. Well, if he's here and nobody else around has a gun, he has at least 50 targets just sitting here waiting for them," said UCF student Bryant Lambe. "Can you look around? Show me a police officer."
Currently, Utah is the only state that allows concealed weapons on campus.
In 1966, a University of Texas professor used his deer rifle to help police take down a sniper who stood on the clock tower and killed several people, even a police officer who tried to keep students safe.
"We're talking about a few seconds here that matter. I'd much rather have a responsible student in the classroom that's armed," UCF student Mark Danielle said.
Students plan to wear holsters all week in protest.
"I don't think that a gun equates to safety on campus, especially in the hands of a student," UCF student Heather Kuhla.
In a statement released to Eyewitness News by UCF officials the school said, "Our stance is that we don't want guns on campus. Protecting the campus should be left up to police."

I know y'all were joking about the squirt guns, but, there have been instances of kids being expelled from schools for having that sort of thing, due to their stupid zero tollerance rules. I read where a kid got the axe for having a little bitty gun likeness on a key chain. If it ain't one thing, it's another...:rolleyes:
