okay, I have cc license. I work for a national company whose corp office is in a different state and they have a weapons policy that states no guns on premises. Every year we are required to read and acknowledge that we will follow these policies including the weapons policy. I had expected that after the law changed in FL around june/july 08 that my employer would have changed that policy but as of today, they have not.

I kind of feel like I dont want to sign something that is a violation of the law, but I don't want to rock the boat either. I am a firm believer that if someone pisses off the wrong people, they will fire you. They will obviously come up with another excuse and not say its for carrying a weapon, but fire you they will.

What do you do?????

Say nothing to your employer (or co-workers) about having a weapon in your vehicle and it will probably never be an issue. Do they randomly search vehicles in the parking lot where you work? If not, how will they ever know you have a gun? In this case, "don't ask, don't tell" is probably the wisest course of action.

If by some chance they do discover that you have a firearm in your vehicle and terminate you for it, you can point to the law as the basis for your wrongful termination suit. The document you signed will not be enforceable; you cannot be made to waive your rights as a condition of employment for any private entity. Nor can they simply 'opt out' of complying with the law.

Glock - you may want to contact the NRA on this. They have people who investigate 2nd amendment rights violations, sometimes list 'offending' companies in their magazines and/or may be able to direct you to a legal firm in your state who handles 2nd amendment questions.

Glock, I'm in much the same position as you. Since the commute to and from work is not particularly hazardous, I respect my employer's wishes in this matter. That's not a legal position- just my personal decision. Life is full of compromises, and, like you, I'm aware of the danger of irritating my employer.

XXXXXXX employees are strictly prohibited from carrying or possessing a concealed or unconcealed weapon and firearms while on company property, in a company vehicle or while carrying out company business. Federal and state law overrides this policy. Violations of this policy may result in disciplinary action, up to and including termination.

Here is What my company says about it; I interpret it as State law says what I can and can't do ?

That's how I read it. If you decide that state and federal law do override your employer's policy in this instance, and if you choose to ignore the policy on that basis, then I'd definitely practice "don't ask, don't tell".

Have you tried discussing it with them and informing that it is in violation of Florida sate law?

One thing to remember though - now is not the time to be loosing a job.

Thanks for your opinions. I probably will just keep my mouth shut. Its unfortunate that I have to but so be it. If I were to run my mouth, someone may try to break into my car or something stupid. Glad to know that signing the policy stating that I wont carry a weapon does not give away any rights or protection I have under the law. :dancingbanana

This Just In

The Weapons and Workplace Violence policy was amended to accommodate recent legislation in a small number of states specifying that companies may not prevent employees in those states from having firearms in their vehicles in company parking lots. This revision does not change our prohibition of firearms in parking lots where there is no conflicting state law.


I am happy to see that my employer made an change to the policy so as not to present themselves as though they were in violation of the law. :dancingbanana

I wouldn't get overly excited about their policy change...from the looks of it, they only did so grudgingly in order to comply with FL law.

I agree that they did not have an epiphany and become PRO 2nd ammendment, but its nice to know that they have at least became smart enough to realize there was a change to the law and so have updated their policy. It is better then keeping the policy unchanged. Either way the law provides the protection it does regardless. It is simply nice to know they pay attention enough to know whats going on around them.

Carry In PLace of Business!

I am a Valid CWL holder and have carried a gun since I have been 21. I recently read my employers handbook and it states that I may not carry in the building. Can they do this since it is a privately owned company?

Irrespective of your CWFL, you can carry in their building, legally, assuming it's not a prohibited place, but they can also fire you for it, or most any other reason.

Unfortunately, yes.

I’m glad they amended the manual in your case, Glock23-4-Me. I had already started typing about checking the last update to the manual in case it was an oversight; thankfully, I decided to go back and read the rest of the posts.
