Most readers of this website will not be surprised that some anti-gun advocates have serious difficulties with facts, truth, logic and the derivatives thereof. Still, Brady bunch* attacks on Florida’s new self-defense law, which took effect on October 1, are so viciously misleading as to eliminate any credibility the group has or ever again will have, even among the more responsible of their own kind. Given the brevity and simplicity of the law, so clearly distorted by the Bradys, the cynical calculation of the group has to be that no one will actually read it.

On its website, in newspaper ads and in flyers handed out in Florida airports to inbound tourists, the Bradys repeatedly label the law as the “Shoot First” law and warn visitors not to argue with, shout at or make threatening gestures to “local people.” A Florida map is made to resemble a handgun. There’s more misrepresentative, hyperbolic scare-mongering.

The Florida law is not a gun law. Period. It contains zero references to guns or shooting, unless you feel propagandistically compelled to count one of those ubiquitous legislative “Whereases” that references the Florida Constitution’s “right of the people to bear arms…”

The Florida law is a self-defense, self-protection law. It has four key components:

It establishes that law-abiding residents and visitors may legally presume the threat of bodily harm or death from anyone who breaks into a residence or occupied vehicle and may use defensive force, including deadly force, against the intruder.

In any other place where a person “has a right to be,” that person has “no duty to retreat” if attacked and may “meet force with force, including deadly force if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself or another to prevent the commission of a forcible felony.”

In either case, a person using any force permitted by the law is immune from criminal prosecution or civil action and cannot be arrested unless a law enforcement agency determines there is probable cause that the force used was unlawful.

If a civil action is brought and the court finds the defendant to be immune based on the parameters of the law, the defendant will be awarded all costs of defense.
Florida’s law, like countless others from legislative sausage grinders, could have been better drafted. It unquestionably will be challenged in court, over and over again, by those who abhor even the concept of applied individual self-defense or by legal gadflies with nothing better to do with their time.

It is a tough law — on those with criminal intent. As is often the case, its ultimate goal is as much to deter as to be used. Whether it ever results in much change remains to be seen. But by removing ambiguities regarding legal responses to imminent threats to life and property and removing an obligation to retreat, the law attempts to rebalance justice on behalf of innocent, law-abiding Floridians, as well as the state’s numerous law-abiding visitors, specifically included. Whether those visitors are comforted or frightened by the law should be based on accurately understanding it, not blatant attempts by a faltering advocacy group to harm Florida tourism.

* The group is one of those with a propagandistic official name which we cantankerously won’t repeat.

This is the specific law which made me start to carry a weapon. Before this it was real sticky to shoot someone in self defense and get away with it. The crooks had all the rights. Run away or take a beating is what you had to do before you could use deadly force. Now I can stand my ground and the law will be on my side. This law also sends a message to the bad guys that honest citizens are not going to take crap anymore.

Well just in Orlando you hear about a car jackings more frequent these days,Home invasions same or someone going to the atm getting robbed.i used to go at night now i just wait til i can go thru the drive through the more fuel prices,Food prices go up,sorry to say crimes gonna go up and if the cops are all tied up keep most of these knuckleheads from steeling gas which seems to be the latest craze.Whos gonna be there for the law abiding citizen
whos at home mnding his/her bussiness.Why weren't there deputies patroling blanchard park where this poor 26 yr old girl who was just out jogging doing nobody an harm they know this rapist has not been caught.its just sad bout what happened to this young lady my heart goes out to her family,but i believe had she been carrying she would be around to tell the story and the BG laying there. My Point is she could have Stood her Ground.

I know this may sound Bass Ackwards but I think the Brady Bunch are accidentally doing us a favor. The best way for a law like this to work is for "Advertizing Concealed Carry" and for all of their ill intent the message coming across is "Be Polite, you never know who is armed." the BG's hear the same message as "You never know who is going to Blow your head off for your chosen career." For a lot of visitors on our roads "There is not a right to road rage, you never know who is armed."

( Oh My Gosh Just joking, Man, try to add some levity here and then listen to all the screaming going on!!! :D )

self Defense

Unless you have a Cop follow you every where you go, you had

better be able to defend yourself these days.

Where are the cops when someone breaks in your home?

When do the cops get to a murder?

When do the cops get to a robery?

And there are still some jerks that want to take this right away from you.

DRB,

You make some valid points, but I am not sure who your comments are directed at.

The "jerks" you speak of, who want to take this right away, are left-wing liberal politicians.

Indeed police officers cannot be parked out in front of your home 24/7, and I am in total agreement with you that you have, and need, the right to keep and bear arms for self defense.

I often told people that the motto of "protect and serve" actually should say " We will protect and serve you as soon as we can, so hold the fort until we arrive. "

Police Officers cannot be everywhere, they do the best job they can with what they have to work with.

Do I expect the police to protect my family and myself? Absolutely not. That responsibility is mine.

Do I expect the police to respond to my call for assistance, to take control of the situation and restore the peace when they arrive? Yes I do, because that is what a Police Officer really is ... a Peace Officer.

So, if you are irked at the politicians who want to take away your right to keep and bear arms, and who want to cut the budgets of the police departments, then I am with you.

If you are directing your comments solely at police officers, indicating they are derelict in their duties of protecting us, then I would suggest that you may want to research a bit more what police officers have to do, and what manpower they have to do it with.

i certainly 100% agree with sarge..yes maybe a few bad apples who seem to get "ALL" the media attention,but no one can count the many times day in and day out a life has been saved,protected,responded to or simply a crime detoured by exposure..as a disabled veteran, i feel the negativity a officer and his family must have knowing this arrogant administration has labeled "me" a terrorist & cut fallen officers & their families benifits by almost 50%..i know most of our local officers in town,a few levy co. sheriffs & about every fl ffw wardens in cedar key....i try to wave every chance i get,or speak when on the water,because, i know things for these officers can turn ugly quick..and the big thing now, alot of the meth labs are running boats & products from yankeetown up to cedar key...imagine firing from a air boat,while being shot at and all the while trying to hang on....i respect em all......

Has this come up in court since it was enacted? I ask cause my class went through this law, but the instructor said it's untested. He still recommended not following this until it has been court tested. You don't want to be the test case.

When it comes to the stand your ground law, I always tell my relatives from California "Basically, Florida has outlawed criminal behavior."

Perps will kill you in a heart beat. LEO will fight to find them and bring to justice. Courts will prosecute and IF CONVICTED they MIGHT BE sentenced to DEATH, after 20 or so years after their appeals are exhausted. Many have died of old age, cancer or something else before the executioner can exercise their trade.

Citizens have the right to kill the SOB and stop all this BS. Quick and firm Justice. I love being in Florida. All you visitors I hope you like it too and do not come with thoughts of hurting one of us, they just may be your last thoughts! Enjoy the beaches, Disney, Universal, and all the other venues.

I too am a firm believer that a one sided story is easier to defend ! It's the only way idiots are made to understand, if they act like a crazed animal . . . they will be exterminated like one, with no second care about their departure from this place or any other ! I am soooo sick of hearing the " but he's a good boy " bull **it ! why didnt they just wing him ? how come they shot him so many times ? etc, etc, etc. They relenquish ALL rights when they CHOSE to act like a scumbag, in my book ! & NO I could never be a LEO ! Have several freinds that are, & lets just say . . . . I wouldnt bring alot of people in for certain crimes ( rape, child predators, praying on the elderly, etc. ) !
