College parking lot...

Hey guys, I know this has been discussed before (I've read the old threads), and I know the law is grey, but I'm a student on a college campus, and I live on a college campus. No guns in the dorms, so I would be forced to leave the gun in my car. From what I've read here, people say it's legal (but iffy). When I spoke with the police (I attend UCF in Orlando), they said they would arrest me (and have done so before) if I was caught (I don't do it now, so don't worry).

What I'm trying to find out is....who can I call to find out what the straight answer is on this? I've been reading my copy of 790, and I'm keep getting re-routed to different parts of the statue with different explanations and blah blah blah. I just want a straight answer. Who in the state should I contact?

Honestly, someone who sits on the Florida supreme court. Good luck with that though. Even a lawyer is not guaranteed to be a 100% accurate but they would be my next guess.

My interpretation is dont do it.

790.06 says No license issued pursuant to this section shall authorize any person to carry a concealed weapon or firearm into any school, college, or professional athletic event not related to firearms;

The only thing you can have is a stun gun or nonlethal electric weapon or device designed solely for defensive purposes and the weapon does not fire a dart or projectile if you are a registered student, employee, or faculty member of such college or university.

Thats my opinion, and everyone has their own.

As to the car, its up to the school as 790.25 states you can but

3. In a vehicle pursuant to s. 790.25(5); except that school districts may adopt written and published policies that waive the exception in this subparagraph for purposes of student and campus parking privileges.
My question is, when looking at 790.251, number 7 says:

(A) Any shcool property as defined and regulated under section 790.115

That section, is the "don't discharge a weapon on school property."

To me, that's a no.

Universities and colleges are not 'schools' , according to FL law. 790.251 does not apply to your question. That is why 790.06 delineates between 'schools' and 'universities/colleges'. Don't take a firearm into a building, and you're fine.

Storing your firearm in your car on a college campus is not illegal. 790.06 prohibits carry in a college/university 'facility'. Parking lots are not part of a college/university 'facility'.

Which police did you talk to? Real police, or campus cops?

If you want a definitive answer, send a letter to the AG, or pay an attorney for his/her time. Anyone else's opininon (mine and/or LEO's) is just that...an opinion.
My opinion, and it is after all MY OPINION after reading Gutmachers book twice...so far.... is that as long as you leave it in the car and do not take it into a school/university campus BUILDING you are within the STATE law.
Concealed carry is carry so as to no one else can tell you are carrying. Put it in your car, leave it there, and don't let ANYONE else know its there and you will probably be fine.

BUT like i said, thats my OPINION and i am not a lawyer, but i would not ask the campus clown force anything that has to do with the law.

They will tell you what they want to be true, which may or may not have any resemblance to reality.

I looked into this recently as I had to visit a campus, within the confines of my vehicle. My interpretation, based on the "Possession Restrictions" part of the Dept of Ag website is that parking lot is fair game.

Possession Restrictions

The following is a list of places where you are restricted from carrying a weapon or firearm even if you have a license. Please note that this is a simplified list. The places marked by an asterisk (*) may have exceptions or additional restrictions. See Section 790.06 (12), Florida Statutes for a complete listing.

o any place of nuisance as defined in s. 823.05
o any police, sheriff, or highway patrol station
o any detention facility, prison, or jail; any courthouse
o any courtroom*
o any polling place
o any meeting of the governing body of a county, public school district, municipality, or special district
o any meeting of the Legislature or a committee thereof
o any school, college, or professional athletic event not related to firearms(doesnt apply to parking lot)
o any school administration building(doesnt apply to parking lot)
o any portion of an establishment licensed to dispense alcoholic beverages for consumption*
o any elementary or secondary school facility
o any area technical center(still dont know what that means)
o any college or university facility*(doesnt apply to parking lot)
o inside the passenger terminal and sterile area of any airport*
o any place where the carrying of firearms is prohibited by federal law

Yep but its better then walking on eggshells behind bars for something we didnt research it is our responsiblity to know what we can and cannot do. But there is a bright side when you get done reading and researching better then the cops out there.
From what I understand, if the parking lot is on college property, you can't keep the gun in there. Your best bet would be to park just off college property, if at all possible.
