Ok here's the situation:

I'm traveling back home to visit family, certain members of which are prohibited possessors. As far as I'm concerned they won't even know I'm carrying (unless I have to use it for SD). I'm pretty sure that I'm in the clear for carrying, I'm more worried about if someone happens to notice that I am and wants to try and make trouble for them. I know I'm probably being a little paranoid but just want to make sure everyone's in the clear. Anyone know any reason to that I, or they, wouldn't be?

Some one who is prohibited from possessing a firearm due to a felony conviction.

What type of trouble could certain members of your family be in if you are legally carrying a concealed firearm?
None I think, I'm just extremely new to carrying (Got my permit about 2 weeks ago) and am not 100% sure.

YOU wouldn't get in trouble regardless. It is the responsibility of the person with the conviction to avoid firearms that they know of or could reasonably believe are present. As long as you don't open carry or let them 'hold' your gun you will be fine. They can't be expected to 'know' you have a piece on you so they are in the clear as well. Unless you are LEO, then it would be reasonable to believe that you are armed and may present a conflict.

Florida Statutes states the following:

790.23 Felons and delinquents; possession of firearms, ammunition, or electric weapons or devices unlawful.--

(1) It is unlawful for any person to own or to have in his or her care, custody, possession, or control any firearm, ammunition, or electric weapon or device, or to carry a concealed weapon, including a tear gas gun or chemical weapon or device, if that person has been:


(a) Convicted of a felony in the courts of this state;

(b) Found, in the courts of this state, to have committed a delinquent act that would be a felony if committed by an adult and such person is under 24 years of age;

(c) Convicted of or found to have committed a crime against the United States which is designated as a felony;

(d) Found to have committed a delinquent act in another state, territory, or country that would be a felony if committed by an adult and which was punishable by imprisonment for a term exceeding 1 year and such person is under 24 years of age; or

(e) Found guilty of an offense that is a felony in another state, territory, or country and which was punishable by imprisonment for a term exceeding 1 year.

(2) This section shall not apply to a person convicted of a felony whose civil rights and firearm authority have been restored.

(3) Except as otherwise provided in subsection (4), any person who violates this section commits a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(4) Notwithstanding the provisions of s. 874.04, if the offense described in subsection (1) has been committed by a person who has previously qualified or currently qualifies for the penalty enhancements provided for in s. 874.04, the offense is a felony of the first degree, punishable by a term of years not exceeding life or as provided in s. 775.082, s. 775.083, or s. 775.084.

As long as the " prohibited possessors " do not " own or have in his or her care, custody, possession, or control any firearm, " I see no problem.

Of course if " a person convicted of a felony whose civil rights and firearm authority have been restored " then the whole matter would be " moot ".

We have an inside family joke that if we ever had a family reunion it would be raided so the cops could get them all at the same time. My immediate family members are quite responsible, but we have some extended cousins that would cause you to want to carry concealed at all times. Thankfully, when they get into trouble they have a different last name so no one associates them with our family. Our family skeletons are not in the closet they line the driveway.

Seriously, keep your gun concealed and on your person at all times. That is how I treat it when I'm around kids all the time. If I'm wearing the gun then I know where it is and do not worry where everyone else is when they are in my home.

Don't even tell these relatives you are carrying, and they won't even know. I wouldn't even steer the conversation towards anything gun related. Just let them talk about what they want to talk about and smile and nod a lot. Don't offer up any information about what you've been up to and everyone will be better off for it.

Seriously, the situation Si no different than walking down the street or going to Walmart. You are surrounded in both places by people who can't legally own or posses a weapon but that doesn't negate your right to bear arms.

Just don't let the relatives hold your weapon and you should be OK.

And if you ever decide to 'stop by the bar on the way home' and the felon holder is driving his car, and you can't take your gun into the bar, then you would not be able to stash your gun under the seat of his car, because that would put him at risk.
Just be careful and use common sense, and maybe always be the one driving.

I have a family member that can't seem to drive after dark without a cocktail. I've lectured him over and over, it's like talking to the wall, therefore I just don't let him drive me anywhere. Just be careful and use your head.

I feel for you. Right now all 3 of my sisters are in jail, along with my brother-in-law. 2 of my neice's have been arrested for varying "infractions", along with another b-i-l.
For the next 2 years, if we were to have a family reunion it would have to be held at jail.:rolf
I think i am the only one in the family that has not EVER been arrested.

But, then again, if we were to have a family reunion, i probably wouldn't go.

Thanks for all the advise guys. MB - It sure sounds like we could be related lol. I'm going to carry, completely avoid the subject of any and all firearms, and as you all said "Smile and Nod"

My brother is prohibited due to mental illness. I carry around him, and he knows I have a gun, but I keep it with me (on me) when I visit him.

I know better than to let him touch it, and I am certainly not going to his neck of the woods without Mr. Springfield.
