On the subject of carrying at home...

When on your own property or in your own home, do you have to conceal or can you go open carry?

Is there different rules INSIDE your home as opposed to OUTSIDE your home but on your property?

If you have blinds and curtains then you can pretty much flash all you want to because the neighbors and passersby can't see you. If you are in the yard and within your property line I would suggest you employ common sense. If the law changes and says I can open carry I'm still not going to do it. I'm not going out of my way to let anyone know I carry. None of my neighbors know.

As a surprise to my husband for Father's Day the kids and I got out in the yard and did three hours worth of work mowing, trimming, gathering and bagging the debris. I even got a ladder and climbed up and trimmed tree limbs. All the while I'm carrying the 9mm on my hip. I was bending, reaching and stretching. No one saw a thing because I strategically placed my sweat rag over the top of the gun handle. We live on a cul-de-sac and the neighbors were not home that morning. It was just me and two kids outside and would have been a perfect opportunity for some mischief. I was not going to be caught off guard. We went about our yard work and no one would have known I was armed.

Common sense goes far. Just because you can do something doesn't mean you should. Just my humble .02 worth.

790.053 (open carry prohibition) does not apply when at your home. "Home" means your property as well. OC is fine.

This is assuming you live in a house (free standing dwelling). If you live in an apt or own a condo, the rules change.

ETA: MamaBear has some good points. Just because you can, doesn't necessarily mean you should. If I'm out working in the yard, there's a j-frame in my pocket...That being said, I don't always grab a cover shirt to run out to the truck for a moment, or to take out the trash.

Two good answers so far. It is legal but not necessarily a good idea. Just use some common sense.

As for me, I do a mixture. I usually carry concealed but depending on my mood and the clothes I'm wearing I sometimes carry OC. I have no problems with OC in my backyard but I try to avoid it in my front yard or where the neighbors will notice. Though, like Rvrctyrngr I'm won't fool with grabbing a cover shirt if I need to run to the truck for a minute.

I like to OC, but using a weed wacker with an M4 slung across my chest has proven to be problematic. :D
I don't edge or weed whack. We saved that part for dh. [g]

I did have fleeting images of TampaSSgt. falling off his ladder though as I propped my ladder up against the tree to trim branches. It was mostly stable and I didn't climb the tree *too* much. Tampa, just so you know, I did NOT stand on the very top of the ladder where that little sticker says to not step. I was sure tempted though because I had to leave few small branches that need to come down.

So is what you are saying that I should NOT be drinking my morning coffee while standing in my front yard with camo paint head to toe and a fully automatic M-60?

Kidding, I was wondering more for like you guys said:

Oops,I forgot something in the truck and I'm too lazy to cover up the gun on my belt.

I am working in the garage with the door open and I am wearing a gun.

I walk out in the backyard to pick up some leaves that blew in my yard from the neighbor's stupid magnolia tree that sheds leaves like crazy...and gun is showing.

That type of thing.



Or here's another thing...

Inside my home (freestanding, single family house), someone comes to the door, I see them, do not know them, and are not sure I like the way they look...

If I answer the door with gun on belt, and let's say HAND ON GUN...if that person turns out to be a cop, am I in trouble?

I have to be honest with you and say I do not answer my door to anyone except UPS and FedEx. They bring me books and it makes me happy. :dancingbanana

When someone other than these guys knock on my door I can usually tell it is a 'sales type' person. Usually, I don't even acknowledge I'm home. On the rare times I do I answer through the door and tell them I am not comfortable opening the door. If they have information they'd like me to look at then please leave it at the door and I will look at it later. No one has ever gotten ugly with over the way I handle it. Mostly, though I just don't acknowledge I'm home and they go away. It is not rude to not open your door. I do not owe them anything.

No one did know, until that 1 range morning my AR15 case busted & I had to carry out my AR in plain site to the trunk of my car in my driveway.
I thought no one saw, but a neighbor did.
Turned out he was in the market for 1. We talked. All is good.:rolf
Honestly I don't care. In today's world people realize they need to be prepared, & cause FL law is so lax your never going to know if someone is packing.

There was a news story a few months ago about an elderly woman pulling her Glock out to fend off a crazed road range driver.
There's a lot of woman on this board I'd never expect to be packing.

Hmm... I imagine I would get odd looks from the neighbors if I go out with my AR10 w/telescopic sights slung across my back... so I DON'T:D

However, I HAVE been known to stick my Glock 23 in my pocket (in a triggerguard-protecting holster) to walk out to the SUV in the front yard..... no neighborly hysterics yet!!!!:laughing

Wellll....it did happen to me once. Just out of the hospital after surgery...flying on pain killers. Someone beating on my door at 1 in the afternoon....answered the door with a G23 behind my back (was expecting a UPS delivery of a rifle)....US Marshal looking for the former owner of the house....never saw the gun...non event.

Technically I think you're still legal. Definitely legal if your hand is not on the gun. With your hand on the gun, you're getting close to handling in a threatening manner.

Keep in mind that if the person is a LEO, he may be uncertain of the law. I would not want to open the door with my hand on the gun.

They have this amazing new device; it's called a peephole...it's like a tiny little window in your door so you can see who's on the other side. You might want to look into it. :rolf
