While there is no doubt this lower court ruling will be challenged, I am still very glad a California Court decided a firearms case correctly on the very clear and plain language of the 2nd Amendment of the U.S. Constitution! (y)(y)

Every once in a while a court gets it right!


I'll be the first to say , I am 'Totally Shocked' , especially coming out of the State of Kalifornia . Now we just need the Other [ 49 ] to follow suit . HOPE ? ? :unsure:

It looks like we think the same again my friend . This is a numbers game and at present we do not have the numbers country wise , House or Senate wise . You can Bet once the Dim's pack the SCOTUS , Those #'s will increase Exponentially . :unsure:

If I remember correctly, this is the same judge who has issued similar pro 2A rulings in the recent past.
Judge Roger Thomas Benitez, senior United States District Judge of the United States District Court for the Southern District of California.

The State of California has two options.

1. Challenge the ruling and risk it going to SCOTUS due to a circuit split and SCOTUS ruling in our favor overturning every AWB nation wide.

2. Don't challenge it and simply have California's AWB overturned.

Ignore the ruling, ignore the Constitution, continue business as usual.

I too fully expect a challenge, if one hasn't been filed already.
Surely the work was done on prepping such a challenge many years ago.

What needs to happen now is have 10 Million Californians (or more) rush out and buy every "assault weapon" imaginable.
Clean the shelves bare!! Internet orders too. STOCK UP, California!
Let's see them try to unwind THAT!

If I was dumb enough to live there, mine would be second hand and pay cash. They will data mine the names and be knocking on doors the day after it's overturned.

Well, I was planning a vacation in California but sure not going now that they made the state so unsafe with people walking around with assault rifles.
I wanted to tour the tent cities like San Francisco, and Venice Beach and head to south California and maybe see all of the children that were put in cages by President Trump.
It is a wonderful thing when you have the government of a state like California spending a lot of time disarming the citizens while about a quarter of the California population is living in tents on the streets and starving and un-employed.
Yes, The Communist, Socialist, Democrat Politicians are doing a fine job of helping the people by handing out needles and I see they started handing out poop bags for people to use. If needed.
This is one fine state and probably the future of America if .the communist keep stealing elections and getting away with it.

I’m chilling out up in the mountains but was able to get the Internet working. I read the entire order and have a few observations: the order was pretty well reasoned, it was about 90 pages long. The judge is the same one who struck down the magazine capacity issue recently. That is going to be re-examined during an en banc hearing not scheduled yet that I can see.

The judge sifted through thousands of pages of evidence and made appropriate factual findings. He criticized the state for not presenting any actual evidence on the issues they pushed. One thing was concerning to me, he, at least twice in the opinion referred to large capacity magazine issues and even quoted studies indicating that a ban on large capacity magazines was more effective in crime/violence control than a ban on “AR’s”

Everything the judge said made sense to me as a gun person. He was, however, perhaps the tiniest bit tone deaf by comparing the AR to a Swiss Army knife, a comparison I’ve heard before in gun circles but one that won’t be readily appreciated by the anti-gunners. They will likely rally around that comparison in being critical of the opinion.

The court granted a 30 day stay to allow the Attorney General to appeal to the ninth circuit. He did that because he thought this was a matter of great public importance. Without question, the Decision will be appealed to the ninth and likely there will be a motion for an en banc review following any decision.

This decision, if upheld, will unlikely strike down all assault weapons bans. Forgive the pun but it will be helpful ammunition toward that goal in challenging other states actions. There probably will be an application to the Supreme Court. Unfortunately, I don’t see this case as a panacea but, perhaps a step in the right direction.

The important thing to remember is that a judicial decision rules on the particular facts presented in that case only. This one ruled on California’s legislative decision making based on the unique factors California used in supporting their need for a ban. Inherently, it cannot rule on Colorado’s laws or another state because they are all unique and based on unique facts.

The conspiracy theorists will start soon on either attacking or congratulating the judge. The fact that he is Cuban born may be of import in his awareness of the dangers of an oppressive government and the uniqueness of the second amendment.

It was already unsafe, Ronnie.
Everybody knows (well, anyone with a brain stem knows) that gun laws don't prevent murder, or nut jobs from getting their hands on firearms.
By disarming its citizens, California is less safe in my opinion -- and the California gun crime statistics tend to support that.
Which is to say, even with all the restrictive California gun laws, they sure have a lot of killing going on.
